Some people may consider settling child custody issues as one of the most challenging parts of the process. With the court’s intervention, a judge can help conclude by providing determinations and finalizing them, often documenting the arrangement in a custody order.

Once done, both parents and their child may feel relieved. Still, complications might be more likely to arise later when it is time to follow the order. Some parents find it challenging to comply, mainly if they are having trouble adjusting to their set-up.

But if a parent becomes a habitual violator of the arrangement and its rules, it could turn into a legal concern, warranting the other party to file a petition to enforce the custody order, typically requiring the following information:

  • Details of the determination, including information about the court that issued the order
  • Any information about other actions related to the order, such as modifications
  • Existence of current proceedings that could be relevant, such as adoptions, protective orders or other legal action involving the family
  • Residences of the child and the parents involved

These details are essential, but the petition could include other information, depending on the circumstances.
